You have just completed such a hearing. The commissioner has either given you an oral decision at your hearing or will mail you a written decision within 30 days of the hearing. You and each of the other parties have the right to appeal from that decision by filing a demand for a trial de novo. The appealing party must file the demand and mail copies to all other parties, or their attorneys if represented, within ten days of an oral decision or within fifteen days of a written decision.. Proof of mailing is the responsibility of the appealing party. If no such demand is filed, or if all such demands are later withdrawn, the court commissioner's decision becomes a judgment. The Dane County Legal Resource Center (Room L1007 Dane County Courthouse) has a form available for purchase for use when filing a demand for trial de novo. After completing all the required information, you must file the form in the Clerk of Court's office. Your case will then be assigned to a circuit court judge.
