INSTRUCTIONS FOR COMPLETION OF ASSET SCHEDULE
In each marital dissolution action where either party requests disposition of property, the "Asset
Schedule" form shall be completed and signed by counsel for both parties and filed with the clerk
before noon on the date preceding any settlement conference and/or trial.
(a) In the "Item" column each item of property shall be listed separately.
(b) Under the "Character of Ownership" column each party shall check his or her
contention as to whether the item of property is claimed to be "community
property," husband's separate property, wife's separate property, or it
belongs to some third party. If the property is a combination of more than
one of these, each appropriate column shall be checked.
(c) Under the "Contentions Re Possession" column the husband shall make a
check in the "Husb." column, indication who he contends has possession of
the item of property. The wife shall indicate by a check mark in the "Wife"
column, who she contends has possession of the property.
(d) Under the "Value" column the husband shall enter his opinion of value in the
"Husb." column and the wife shall enter her figure in the "Wife" column. The
value figure shall be the party's opinion of the fair market value, with the
understanding that the Court may treat the figures as being submitted on a "buy
or sell" basis.
If the parties are in disagreement as to the character of any asset, they must attach to the asset sheet
a copy of all documentary evidence which supports their position regarding character.
The spaces at the top of the sheet shall be completed for each sheet submitted, including indicating
the page number and the total number of pages presented.
NOTE:
Only one Asset Schedule is to be filed in a case. Both counsel sign the one document so
that each knows, when each signs, exactly what the other is stating to the Court.
The Asset Schedule, together with all attachments, will be marked as the Court's Exhibit No.
1 and received into evidence if the case proceeds to trial.
