However, there are many exceptions. A few examples would be ownership changes including spouses, domestic partners, parents and their children, and original transferors. There are many more exceptions and each has additional eligibility requirements. When a death occurs of a real property owner, the date of death establishes the date when the change in ownership occurs. Quite often it can be years before estates are distributed. The Assessor cannot complete assessment processes until information is known about the change in ownership. Late information results in corrections to prior years’ assessment rolls and subsequent tax bills. In an effort to avoid generating tax bills after the estate has closed, the legislature added Section 480(b) of the Revenue and Taxation Code. It requires that an administrator or executor file a Change in Ownership Statement with the County Recorder or Assessor in each county where the decedent owned real property at the time of death. The statement is filed at the time the inventory and appraisement is filed with the Court. The Trustee or transferee shall file the statement if the property was held in trust, within 150 days after the date of death. To assist those responsible for making the required filing, the El Dorado County Assessor's Office has made available the Change in Ownership Statement-Death of Real Property Owner form you will find enclosed. It is desirable that a separate statement be filed for each parcel; please duplicate the form as needed. Please be advised that this information is only used to determine if an exclusion from reassessment may be applicable and will not change the vesting of title.
