NOTICE TO PARTIES FILING SMALL CLAIMS ACTION
You must provide your own interpreter if one is needed in court.

You are responsible for having your claim served. Service may be done by a disinterested party who is at least
18 years of age, a legal process server, or the sheriff. He or she must complete a proof of service form and return
it to the court at least five (5) days prior to the trial (Code of Civil Procedure §116.340(c)).
Pursuant to Local Rule 354 of the Superior Court of California, County of Orange:
• Failure to appear at the scheduled hearing may result in the case being dismissed.
• If the defendant is not served, the clerk’s office will reset the claim once, provided the plaintiff furnishes
the clerk’s office with all paperwork issued when the claim was filed.
• Any request for resetting must be done at least three (3) court days prior to the original hearing date.
Pursuant to Section 116.570 of the Code of Civil Procedure:
• After the defendant has been served, any request for postponement must be filed at least ten (10) days
before the hearing. The party requesting the postponement shall mail or personally deliver a copy to
each of the other parties and pay the appropriate fee to the court upon filing the request for
postponement.
You must advise the court of any change of address or telephone number (form #MC-040).
