IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AND FOR THE COUNTY OF SAN MATEO The People of the State of California, Plaintiff, vs. Defendant. ) ) ) ) ) ) ) ) ) Case Number ____________ Department ______________ ORDER PURSUANT TO PENAL CODE SECTION 1210.1 As evidenced by a Proposition 36 completion certificate from a drug treatment program provider, the defendant has successfully completed treatment as ordered and has substantially complied with the conditions of probation. There is reasonable cause to believe that the defendant will not abuse controlled substances in the future. It is therefore hereby ordered that pursuant to the provisions of Penal Code Section 1210.1(e)(1), the conviction for of the Code dated shall be set aside and the complaint or information against the defendant dismissed. It is further ordered that except as provided in paragraphs (2) or (3) of Penal Code section 1210.1(e)(1), both the arrest and the conviction shall be deemed to never have occurred and except as provided in paragraphs (2) or (3) of Penal Code section 1210.1(e)(1), the defendant is released from all penalties and disabilities resulting from the instant offense. Any outstanding fine balance will remain with Revenue Services for collection, pursuant to Section 1214.2(b)(2) and/or 1214(b) of the Penal Code.
