CHECKLIST OF DOCUMENTS TO OBTAIN
A DIVORCE OR LEGAL SEPARATION
WITHOUT CHILDREN
Before obtaining a Decree, you must file the following documents:
q Petition for Dissolution of Marriage or Legal Separation AND
q If your spouse is listed as Respondent on the Petition, you have
filed either:
q The Summons and Waiver and Acceptance of Service, OR
q The Summons and Return of Service.
q Notice of Hearing (if you have a contested hearing)
q Proof of Completion of Mediation (if required)
When you appear in court or file an Affidavit for Decree Without Appearance of
Parties, you must have completed the following documents to give to the Court:
q Two Financial Affidavits (one for you and one for your spouse)
q Separation Agreement / Partial Separation Agreement / Disclosure form for
Permanent Orders
q Affidavit for Decree Without Appearance of Parties
**this form may be used only if you have agreed on all issues and want the
Decree entered without a court appearance.
q Decree (proposed)
q Support Order (if maintenance is involved)
IF THE OTHER PARTY HAS NEVER RESPONDED,
YOU WILL HAVE ONLY YOUR DOCUMENTS TO
SUBMIT.
