INSTRUCTIONS FOR MOTION TO MODIFY
OR TERMINATE MAINTENANCE
The Motion to Modify or Terminate Maintenance is used when there is an existing
maintenance award which was part of the decree of dissolution of marriage, and
circumstances have changed so that either a change in the amount of maintenance or
termination of the maintenance payments altogether is appropriate. You may seek
modification or termination of the maintenance award by filing a Motion to Modify or
Terminate Maintenance if there has been a “substantial and continuing” change in
circumstances (for example, one of the parties has received a significant pay raise or pay
cut), so that the existing maintenance obligation is unfair.
Fill in the amount of the existing maintenance award. If you are seeking a
modification of the maintenance award because of a change in circumstances, describe
that change in circumstances fully and explain why the existing maintenance obligation is
unfair.
You may also seek termination of the existing maintenance award if the party who
has been receiving the maintenance payments has remarried or died, or if some condition
for termination of maintenance specified in the decree of dissolution of marriage has
occurred. If you are seeking termination of maintenance payments for those reasons,
describe the reasons fully in paragraph 3.
