PROVISIONAL ORDER TO TRANSFER GUARDIANSHIP
AND NOW TO WIT this _____day of________________, _______, the Court having
reviewed the petition to transfer guardianship from the State of Delaware to the State of
_______________________ and notice having been provided to all required parties without any
objection being heard or following a hearing on the petition to transfer held
on_______________________;
IT IS HEREBY ORDERED that:
1) The guardianship of the above named disabled person is hereby provisionally
transferred to the State of _______________________.
2) The petitioner shall file a petition for guardianship or transfer of guardianship in the
State of _________________________.
3) Once a Court in the State of ______________________ grants a provisional order
accepting jurisdiction of the above guardianship, the petitioner shall file a copy of that
order with the Court of Chancery.
4) After all of the requirements in 12 Del.C. ยง 39A-301 (f) are satisfied, the Court may
issue a final order confirming the transfer and terminating the guardianship in the
State of Delaware.
