MOTION TO VACATE JUDGEMENT
Instructions: Please check the appropriate box and complete all sections that apply to your ticket.
Deemed admission: The deemed admission to the violation is entered when the vehicle owner does
not answer a ticket within 60 calendar days of the date it was issued. This form cannot be filed if a
deemed admission was entered on a moving violation.
Default judgment: A default judgment is entered if the ticket was scheduled for a hearing but the driver
or vehicle owner did not appear and the hearing examiner found you liable based on the government’s
evidence.
Adjudication Services will grant a request for a hearing after a default judgment has been entered ONLY if all
of the following items apply:
1. The vehicle was registered in your name or you have a notarized power of attorney form from the
registered owner.
2. The judgment was entered within the last 60 (sixty) calendar days.
3. You prove that:
a. There was excusable neglect in your failure to respond; and
b. You have a substantial defense to the violation

SECTION II: EXCUSABLE NEGLECT

The notice was not mailed to the address where my vehicle is registered. (Submit a copy of the vehicle
registration at the time the judgment was entered)
I had a serious medical condition when the judgment was entered. (Submit a copy of health records.)
I was incarcerated at the time the judgment was entered. (Submit proof of the time period you were
incarcerated.)
I serve in the military and am covered by the Soldiers and Sailors Act. (Submit proof of active military
service at the time the judgment was entered.)

PARKING TICKET (DEEMED ADMISSION)

I was not the vehicle owner at the time the ticket was issued. (Submit proof of ownership with dates).
I reported my vehicle stolen at the time the tickets were issued or the tickets were issued to my tags
which were stolen (submit a copy of police report).
The relevant signs prohibiting or restricting parking were missing or obscured. (For example, submit
photographs covering the side of the block where the vehicle was parked.)
The relevant parking meter was inoperable or malfunctioned through no fault of my own. (Submit the
claim number you received when you called in the broken meter.)
The ticket is defective. (Submit an explanation with documentation as to why the facts on the ticket are
inconsistent with the violation.)
The vehicle was suddenly mechanically disabled and couldn’t be moved. (Submit proof that the vehicle
was inoperable and/or was repaired.)
I suddenly needed immediate medical assistance. (Submit a copy of health records.)
