170.05 Combined FELA & Safety Appliance Act or Boiler Inspection Act Case--No Assumption of Risk by Employee At the time of the occurrence there was in force a federal statute which provided that in any action brought against a railroad to recover damages for [injury to] [the death of] an employee, the employee shall not be held to have assumed the risks of his employment in any case where the [injury] [death] resulted in whole or in part from the negligence of any of the officers, agents, or employees of the railroad or where the violation by the railroad of any statute enacted for the safety of the employee caused, in whole or in part, the [injury to] [death of] the employee.
