This Court, having considered all pleadings and objections thereto, if any, and after an evidentiary hearing pursuant to 20 ILCS
2630/5.2(d)(7), finds that:
1.
On _______________________________, __________, the Prosecutor(s)/State’s Attorney Arresting Agency(ies)
Illinois State Police Chief Legal Officer(s) of the Unit(s) of Local Government affecting the arrest(s) objected to
Defendant/Petitioner’s Petition to Seal within 60 days of the date of service of the Petition to said agency by filing an
Objection to Expungement or Sealing Petition with the Clerk of the Circuit Court, and stating with specificity in writing
the basis of the objection, pursuant to 20 ILCS 2630/5(d)(5)(A) and (B).
2. Defendant/Petitioner’s record is not eligible for sealing relief because:
a.
The Defendant/Petitioner was placed on supervision for or was convicted of a sexual offense committed against
a minor, or an offense under Section 11-501 of the Illinois Vehicle Code or a similar provision of a local
ordinance, or an offense under Section 11-503 of the Illinois Vehicle Code or a similar provision of a local
ordinance, or
b.
The Defendant/Petitioner was placed on supervision, qualified probation or was convicted of an offense
included in Article 11 of the Criminal Code of 1961 or a similar provision of a local ordinance, except Section
11-14 of the Criminal Code of 1961 or a similar provision of a local ordinance, or an offense under Section
12-15, 12-30, or 26-5 of the Criminal Code of 1961 or a similar provision of a local ordinance, or an offense
defined as a “crime of violence” in Section 2 of the Crime Victims Compensation Act or a similar provision of a
local ordinance, or an offense which is a Class A misdemeanor under the Humane Care for Animals Act, or an
offense or attempted offense that would subject the person to registration under the Sex Offender Registration Act.

c.
4 years or
3 years has not elapsed after the termination of the Defendant/Petitioner’s last sentence.
d.
The Defendant/Petitioner’s supervision was not successfully completed.
e.
The Defendant/Petitioner failed to attach the required drug test.
f.
The Defendant/Petitioner’s drug test showed the presence of an illegal substance.
g.
Minor traffic offenses are not eligible for sealing, unless the petitioner was released without charging.
h.
The Petition is to seal a felony offense and the charge has not been amended to a misdemeanor, nor has it
resulted in first offender probation.*
i.
The Petition is to seal a Class 4 felony. The Defendant/Petitioner had prior felony records sealed.
