APPEALS – INFORMATIONAL HANDOUT
A. Appellant files with the Clerk of the Circuit Court, “Notice of Appeal” within 30 days after judgment
entered.
“Notice of Appeal” should contain the caption of the case and case number, what order or judgment is
being appealed, the date of judgment and the judge who entered the order.
Original “Notice of Appeal” to be filed with the Circuit Clerk’s Office, requiring a $75.00 deposit. A
copy is to be served upon the opposing side. Proof of Service of Notice to be filed with the Circuit
Clerk’s Office. Proof shows how notice is served.
TWO WAYS TO SERVE:
1. By mail – Proof should state what mailbox or what corner of what city or what date at what
time and signed by the person mailing.
2. By direct delivery – have receipt signed when making delivery, either by secretary or party
being served.
B. Clerk will prepare the Appeal Record. There will be a fee for the preparation of the record – the cost
depends on how many pages the record contains. $75.00 for under 100 pages, $150.00 for over 100
pages, and AN ADDITIONAL 25 CENTS FOR EACH PAGE OVER 200.
C. DOCKETING STATEMENT; FILING FEE: Within 14 days after the filing of a notice of Appeal, the
appellant shall file with the Clerk of the reviewing Court (Appellate Court) a Docketing Statement,
together with proof of service thereof, and the required filing fee of $25.00, if not already paid.
D. When the record is prepared, the appellant is notified. He will receive a copy of the Appeal Record
upon paying the fee. The original Appeal Record will be mailed to the Appellate Clerk’s Office,
Ottawa, Illinois within 63 days of the filing of the Notice of Appeal.
E. Appellant’s first Brief is due 35 days after the date on which the record of appeal was filed in the
reviewing Court (Appellate Court). The Brief should contain objections.
Appellee’s Brief is due 35 days thereafter.
Appellant’s Reply Brief is due 14 days thereafter.
