CONDITIONS OF PROBATION
Introduction
The Court has placed you on Probation, expecting you to use this opportunity to prove to yourself
and to others that you are capable of living a socially acceptable life as a productive and responsible, law-abiding
member of society. Probation is not leniency, but rather a form of treatment consciously chosen because there is
reason to believe that the objective of justice will be fulfilled and the interests of society protected, while at the
same time, your needs as the offender will be met.
A Probation Officer will be assigned to work with you, to help you make an acceptable social
adjustment. The Officer will help you in every way possible, will be available for counseling when problems arise,
and will submit regular reports of your progress to the Court.
It is also the Probation Officers duty to require you to live by the conditions of Probation. The Officer has
the authority and responsibility to enforce these conditions by notifying the Court of any violation and
recommending your appearance before the Court as a Probation Violator.
Your goal is to terminate your sentence successfully. This can be accomplished if you will demonstrate an
acceptable attitude and responsible conduct of the Court, you may earn a final release from Probation and retain
the privileges and responsibilities of citizenship.
The conditions of Probation have been carefully designed as guidelines for acceptable Probation behavior.
If you should violate one or more of these conditions of Probation, the Court has the legal authority to revoke your
Probation and commit you to a state institution to serve your sentence.
FINANCIAL AGREEMENT
In addition to other conditions of Probation, all individuals on Probation shall pay an Administration Fee, an
Initial User Fee, and a Monthly User Fee. This Fee is to be paid to the Porter County Adult Probation Office by
the 5th day of each month. Only a Cashiers Check, Money Order, cash or GPS Government Payment Service
Generated Credit Card Receipt will be accepted. Failure to pay these User Fees will constitute a violation of the
Court Order.
I further understand that if I am granted permission to be in another state, or if I should be there without
permission and my return to Indiana is authorized, I hereby waive extradition to the State of Indiana and agree not
to contest efforts to effect such return.

PROBATION CONDITIONS
Comes now the Porter County Adult Probation Department by Officer, __________________________,
who informs the Court that the Honorable _______________________, Judge of the ________________ Court of
Porter County, is granting me the privilege of Probation as permitted by the Laws of the State of Indiana and
further advises me that the Court may, at any time, revoke my Probation for cause, modify the conditions of my
Probation or extend the period of said Probation. It being necessary, therefore, that I comply with the following
restrictions during the time I am on Probation as prescribed by I.C. 35-38-2-1.
1. REPORTS: I shall submit a written monthly report to the Probation Office before the 5th of each month. This
report shall be true and correct in all respects. In addition, I shall report as directed to my Probation Officer,
according to the Indiana Case Classification System. In Specific:_____________________________________

2. EMPLOYMENT: I shall work faithfully at suitable employment or faithfully pursue a course of study or
vocational training that will equip me for suitable employment. I shall report any changes in employment to my
Probation Officer within 24 hours. I will also submit pay stub receipts upon request. If not employed, I must
attempt to find a job.
3. MEDICAL TREATMENT: I shall undergo available medical or psychiatric treatment and I shall remain in a
specified institution if required for that purpose. I shall sign all necessary releases of information. This
information is to be sent to my Probation Officer.
4. FINANCIAL OBLIGATIONS: I shall pay my financial obligations to the Court in the specified time, mailing
or personally delivering my Fines, Court Costs and Restitution to the Clerk. Probation User Fee payments to be
made payable to the Probation Department. I shall make restitution or reparation to the victim(s) of my crime(s)
for the damage or injury that was sustained by the victim(s) as ordered by the Court. I shall also support my
dependents and meet other family responsibilities.
5. WEAPONS: I shall refrain from possessing any firearms, destructive devices, or other dangerous weapons
unless I am granted written permission by the Court.
6. OUT OF JURISDICTION TRAVEL: I shall remain within the jurisdiction of the Court, unless I am granted
permission to leave by the Court or by my Probation Officer. Written permission must be obtained to leave the
State of Indiana for longer than 24 hours.
7. COOPERATION: I shall at all times cooperate with my Probation Officer and my behavior and attitude shall
justify the opportunity granted to me by this Probation. I shall always consult with my Probation Officer and
obtain his/her written permission before obtaining a Driver’s License. I shall permit my Probation Officer to visit
me at my home or elsewhere. I shall immediately notify my Probation Officer of any change in address or
employment. I shall waive my fourth amendment right and allow reasonable search of my home, vehicle and/or
person by my Probation Officer and/or law enforcement with my Officer present. I shall answer all reasonable
inquiries by the Court or my Probation Officer. Failure to comply within 24 hours to the above shall be considered
a violation.

8. INTOXICANTS: I shall not purchase, possess, or drink any intoxicating beverages. I shall submit to alcohol
testing upon demand. I shall not enter bars or establishments where alcohol is sold.
9. NARCOTICS: I shall not use, purchase, possess, give, sell or administer any narcotic drugs, nor any
dangerous drugs, unless first prescribed by a licensed physician. I shall submit to narcotic or drug testing upon
demand.
10. ASSOCIATES: Former inmates of Penal Institutions and individuals of bad reputation shall be avoided. I
shall not associate with anyone who is likely to influence me to commit any crime.
11. LAWS AND CONDUCT: I shall comply with all Municipal, County, State and Federal Laws, Ordinances
and Orders, and I shall conduct myself as a good citizen. If arrested, I shall report this fact to my Probation Officer
within 24 hours. An arrest is considered a violation of Probation, and a Petition will be filed with the Court.
12. DRIVER'S LICENSE: If my Driver's License or privilege is suspended, I shall not operate a motor vehicle
during the period of suspension.
13. UNDERCOVER AGENT: I shall not serve as an undercover agent or be an employee of any law
enforcement agency while on Probation, without permission of my Probation Officer and/or the Court. If
approached to do undercover work, I will report this fact to my Probation Officer within 24 hours.
14. ALL OTHER ORDERS OF THE COURT: (i.e., Porter County Alcohol & Drug Offender's Service PCADOS, Alcoholics Anonymous - A.A., Narcotics Anonymous - N.A., Antabuse, Mental Health Counseling,
Project PRO, Prisoner and Community Together - PACT, etc.)

I have read and understand the above and foregoing. I accept the privilege of being on Probation and I
promise to comply with all of the above. I further understand that if I fail to comply with these provisions, my
prison sentence can be imposed. I also understand that I am required to follow the Probation Officer's instructions
and advice. The Law gives him/her the authority to advise me regarding my social activities. Should I leave the
State of Indiana without permission, I waive extradition from the State in which I am found to the State of Indiana.
The above INTRODUCTION, AGREEMENT and PROBATION CONDITIONS have been explained
to me by both the Sentencing Judge and my Probation Officer, and I understand them.
