In the above matter the
Complaint for child custody

Each party is expected to be present with or without counsel and to make a good faith effort to mediate
all disputed issues. Prior to that date, each party is expected to confer with counsel to determine what
information is needed at the mediation session. A copy of the publication "Mediation of Divorce in
Maine" is enclosed. In order to prepare your client for mediation and to maximize its success, please
mail to your client the enclosed booklet and the notice of mediation.
* * IMPORTANT * *
IF THE COURT FINDS THAT EITHER PARTY FAILED TO MAKE A GOOD FAITH EFFORT TO
MEDIATE, THE COURT MAY ORDER THE PARTIES TO SUBMIT TO MEDIATION, MAY
DISMISS THE ACTION OR ANY PART OF THE ACTION, MAY RENDER A DECISION OR
JUDGMENT BY DEFAULT, MAY ASSESS ATTORNEY'S FEES AND COSTS OR MAY IMPOSE
ANY OTHER SANCTION THAT IS APPROPRIATE IN THE CIRCUMSTANCES. THE COURT
MAY ALSO IMPOSE ANY OTHER SANCTION UPON A PARTY'S FAILURE WITHOUT GOOD
CAUSE TO APPEAR FOR MEDIATION AFTER RECEIVING NOTICE OF THE SCHEDULED
TIME FOR MEDIATION.
If either party cannot attend, a written motion to continue must be filed with the Court within one week
of this notice and presented by counsel to a Judge/Justice.
If both parties agree to cancel a scheduled mediation, notice must be given to the Clerk of Court at least
48 hours prior to mediation. If you do not cancel your mediation session and you do not appear for it,
to schedule another mediation session you will be required to pay an additional $120.00.
The State of Maine Child Support Guidelines law requires that prior to mediation the parties exchange a
completed income affidavit and a worksheet. A complete copy of the law is available in the county
courthouse libraries and from attorneys.
