INSTRUCTIONS FOR COMPLETING THE COMPLAINT FORM
Before filling out the Complaint Form, please take the time to read these
instructions. They will help you to understand what the Securities Division can do, and
we will be better able to understand and act on your complaint.
What We Can Do:
We investigate complaints against individuals and businesses accused of
violating the licensing, registration or anti-fraud provisions of the Maryland
Securities Act, the Maryland Franchise Law, and the Maryland Business
Opportunity Laws. We can issue orders or file lawsuits to stop these violations
and, in appropriate cases, we may refer matters for criminal prosecution.
What We Cannot Do:
The Division cannot act as a court of law. We cannot order that money be
refunded to you, that contracts be canceled, or that damages be paid.
Sometimes, in the course of our enforcement case against a violator, the person
or business may offer to settle your complaint with you, or a court may order that
the violator pay restitution to you. Please keep in mind, however, that we cannot
act as your private attorney. You should consider consulting private counsel
regarding your complaint or monetary compensation due you.
How You Can Help Us:
A.
Summarize your complaint using these guidelines and the attached
questionnaire.
1.
Tell us what happened. Start from the beginning; include how you first
learned of the investment (e.g., advertisement, phone call, personal
contact, Internet). Please be specific about what was said and who said
it.

Tell us who was present during these conversations or acts.
3.
Tell us when and where these conversations/acts took place.
4.
Tell us when and where the money and agreements changed hands.
5.
Tell us why you believe that the representations made to you were false
or incomplete or why you believe that your money was misused.
6.
Please type or print clearly in ink.
B.
Documentary evidence is especially important. Please photocopy all documents
such as contracts, agreements, certificates, notes, trust deeds, correspondence,
legible copies of the front and back of all checks involved, escrow documents,
advertising, etc. Attach these copies to your written complaint. Keep your
Originals in a safe place.
