Do you need an attorney? Togetanorderevictingthemobilehomeownerfromyourmobilehomepark,youmustfileacomplaint withthedistrictcourtinthecountyorcitywherethepropertyislocated.Youcanhireanattorneyor representyourself.Ifyoucanfollowallthestepsoutlinedinthispacket,youmaynotneedanattorney. However,ifafterreadingthispacketyouthinkyouneedassistance,youshouldcallanattorney.Ifyou arenottheownerorsublessoroftheproperty,anattorneymustsignthecomplaintandappearincourt. FilloutformDC102d(Complaint,TerminantionofTenancy,MobileHomePark-MobileHomeOwner (Just-CauseTermination)onthewebsiteorgetapapercopyoftheformfromthecourttofillout.Follow theinstructionsonpage8.AftercompletingformDC102d,printfourcopies.Ifthereismorethanone defendant,youwillhavetomakeextracopiesforeachdefendantbeforeyoufileyourcomplaint. FilloutthetoppartofformDC104(Summons).Youwillprovidethesummons(formDC104)tothe courtwhenyoufilethecomplaint(formDC102d).AftercompletingformDC104,printtheform.Twoof thecopiesareforthetenantandcontainasectiononhowtogetlegalhelp.Theremainingthreecopies containasectionforcertificateofmailing.Finally,therearetwoproofsofservice. 4. Put your packet together. File the Complaint packet with the court. Step 5a: Filing with the court in person and making arrangements for service by the court Filing the Summons and Complaint packet:Taketotheclerkofthecourtinthedistrictcourtwhere yourpropertyislocatedallfourcomplaintpackets,thefifthcopyofthesummonsformDC104thatyou madeinStep4,andthetwoproofsofservicefromformDC104.Bringyourpaymentforthefilingfee withyou. Bepreparedtopayforthecostofservice.Thisincludesthecostofservingtwopacketstothedefendant, onebyfirst-classmailandonebypersonalserviceordeliveryasrequiredbyMichiganCourtRule 4.201(D).Thiscosts$26.00plusmileageforeachdefendant(tenant). Theclerkwillrecordthefilingofyourcomplaint,assignacasenumber,andwritethenameofthejudge assignedtoyourcaseonallcopiesofthesummonsandcomplaintforms.Theclerkwillissuethe summonsbydating,signing,andsealingthesummons. Serving the Summons and Complaint packet:Theclerkwillkeeptheoriginalofthesummonsand complaintpacketforthecourtfile,willmailonecopytothedefendant,willmakearrangementsfor personalserviceordelivery,andwillreturntheremainingpackettoyou.
