The impact of Assembly Bill 334, which added language to NRS 239B, providing for the protection of social security numbers in public documents will be felt by all those filing or submitting documents in the County Clerk's Office. NRS 239 is the Public Records chapter. The provisions in this chapter apply not only to the County Clerk's Office, but to a variety of public agencies. The new statute requires that affected agencies take necessary steps to provide notice of this change to individuals with whom it conducts business. In addition to information provided on this web site, hard copy notices will be posted in the public areas of our Civil/Criminal and Family Court locations, as well as at our County Commission Division. Pursuant to NRS 239B.030, effective January 1, 2007, "a person shall not include and a governmental agency shall not require...the social security number of a person on any document that is recorded, filed or otherwise submitted .... " unless it is required pursuant to a specific state or federal law for the administration of a public program or for an application for a federal or state grant. NRS 239B.030 further states agencies may require that each person filing or submitting a document provide an affirmation stating the document does not contain a social security number. Beginning January 2, 2007 the Clerk's Office will require that an affirmation be attached as the last page of each document presented for filing or submitted to this office. For example, if a party is filing a Motion with several exhibits attached, the affirmation should be included as the final page, following the exhibits. Another example, an affirmation will also be required for the Cover Sheet which is a separate document being submitted to the Clerk's Office. Do not place the affirmation between the signature page and the exhibits. Doing so would require Clerk staff to peruse through each document in order to locate the affirmation. This would require a great deal of time and result in unnecessary delays at our customer counter. A suggested format for the affirmation is posted on our web site as a convenience for Court users. Parties are not required to use the form as long as an affirmation stating the document does not contain the social security number of any person is attached as the last page. A copy of the suggested format is also included below. The affirmation becomes part of the actual document, so all subsequent copies of the document must also include the information or they would not be a true and accurate copy of the original.
