PUBLIC CELBRATION PERMIT APPLICATION
THIS APPLICATION MUST BE RECEIVED BY THE DIVISION AT LEAST 10 DAYS PRIOR TO THE EVENT.
INSTRUCTIONS
Eligibility and requirements - Only the holder of a New Mexico Winery/Winegrower’s or Small Brewer’s License may apply for a Public Celebration Permit.
The license holder must complete the application, indicating his license number and name of business. A detailed floor plan or diagram must be submitted
showing exactly where the celebration is to be held. The serving areas must be clearly marked. Entrance, exits, and enclosed or barricaded serving areas must be
disclosed. Describe event type such as fair, fiesta, performance, athletic event, etc. NO FAXED APPLICATIONS WILL BE ACCEPTED. The liquor license
must not be in suspension or have pending citations.
Events that require a Public Celebration Permit - If the license holder will be serving alcoholic beverages from any place other than the approved and
designated liquor licensed premises, a permit is required.
Submission and Fees - All applications and fees must be received by the Alcohol and Gaming Division at least 10 days prior to celebration. The fee is $10 per
day on days which the celebration is held, which cannot exceed three days unless the Director approves a longer time, and cannot be more than 12 hours per day.
Fees processed are not refundable even if the event does not take place at the date and time for which the permit is issued.
Provision of Wine/Beer - Only the holder of the Winery/Winegrower’s or Small Brewer’s License can provide the wine/beer to be served.
Sale of Wine/Beer - If there are sales of wine/beer, the total gross receipts from the sales must be reported to the Taxation and Revenue Department on the tax
number of the Winery/Winegrower’s or Small Brewer’s Licensee.
Dispensing of Wine/Beer - Only the holder of the winegrower or small brewer liquor license and its employees who obtains the Public Celebration Permit can
sell and dispense the wine/beer.
Hours of Operation - The Public Celebration Permit allows the serving of wine/beer to begin at 12:00pm and service must end at 11:00pm.
Events held on Sundays - The city or county where the celebration is to be held must have authorized Sunday Sales.
Removal of wine from area of the celebration - The licensee is authorized to dispense wine by the drink for consumption at the celebration. By-the-drink
dispensed wine cannot be removed from the area of the event. The licensee is authorized to dispense wine in unbroken packages. The unbroken packages may
be removed from the area of the celebration.
Posting of Public Celebration Permit at event - The Public Celebration Permit and all legally required signs (i.e., pregnancy, firearms, minors, etc.) must be
prominently posted at the locations where the alcohol will be dispense
Include required documentation - List of servers who will be at the event with their server permit number. A detailed floor plan designating restricted and
unrestricted areas. Don’t forget to include the fee!
