The Uniform Civil Rules of the Supreme and County Courts, at 22 NYCRR 202.70 (a) and
(b), define what qualifies as a "commercial case”. To avoid administrative delay, counsel are
cautioned to consult the Rules before completing this Certification. Please note also the following:
As of August 9, 2007, the Commercial Division, Erie County will be
assigned only those commercial cases in which the amount at issue exceeds
$50,000, exclusive of punitive damages, interest, costs, and attorney fees;
and exclusive of any non-commercial claims, non-commercial cross-claims,
or non-commercial counterclaims.
