COURT NOTICE REGARDING AVAILABILITY OF ELECTRONIC FILING
PLEASE TAKE NOTICE that
, a party to the matter captioned above,
will participate in electronic filing for this matter through the New York State Courts Electronic Filing
System (“NYSCEF”). This option is available to all parties to this matter. This Notice is being served
pursuant to the NYSCEF Rules for the Surrogate’s Court (Section 207.4-a of the Uniform Rules for the
Trial Courts).
General Information
In New York State, actions may be commenced and cases processed by means of the NYSCEF
system in certain proceedings in Surrogate’s Court, defined in the NYSCEF Rules, in Chautauqua, Erie,
Monroe, Queens and Suffolk Counties, as well as in designated matters in the Supreme Court and the
Court of Claims. Electronic filing is also available in the New York City Civil Court.
Electronic filing offers significant benefits for attorneys and litigants, permitting papers to be filed
with the court and served in a simple, convenient and expeditious manner. Documents in NYSCEF cases
are filed with the court by filing on the NYSCEF website (www.nycourts.gov/efile), which can be done
at any time of the day or night on any day of the week. Documents are deemed filed when transmission
to NYSCEF is complete and payment of any court filing fee due is received by the court. E-filers can use
NYSCEF to serve papers on parties over whom jurisdiction has been obtained and who have consented
to participate in electronic filing. There is no fee for using the NYSCEF system, nor for printing documents
from it, though normal court filing fees still apply. Fees can be paid by credit or debit card on-line, as well
as in person and by mail. Participants in e-filing obtain immediate notification of the filing of and access
to documents filed by the court, such as decrees, orders, decisions and judgments. All documents filed in
a Surrogate’s Court matter through NYSCEF are treated as secure documents, meaning that they are
available in NYSCEF only to those who have consented to use NYSCEF in that matter.
Instructions
Use of NYSCEF is voluntary. Parties to this matter who wish to participate in electronic filing
must promptly submit a consent to electronic filing, which may be done on-line, or, if the court in question
permits, by service and filing of a consent form (available in the “Forms” section of the website). In order

to consent on-line and to file and serve documents through NYSCEF, the attorney for a party or a selfrepresented party must complete a Filing User Registration form (available in the “Forms” section of the
website), print and sign it and submit it to the NYSCEF Resource Center (efile@courts.state.ny.us). A
confidential Filing User Identification Number and Password necessary to use the system will be
transmitted to the filer shortly thereafter. The filer may then log onto the NYSCEF site and consent in the
case in question. An attorney for a party who is admitted in New York and has already registered with
NYSCEF need not re-register, but may consent electronically on the NYSCEF site.
