SMALL CLAIMS INSTRUCTIONS (FOR MONEY OWED AND/OR RECOVERY OF PERSONAL PROPERTY) GENERAL : 1. The money limit in small claims is $4,000.00. 2. NO PERSONAL CHECKS - MONEY ORDERS, CASH OR BUSINESS CHECKS ONLY. 3. The Defendant(s) MUST be a resident of Mecklenburg County and you MUST furnish a full name and address. You may use a work address. A Post Office Box Number cannot be used. 4. Be sure to use zip codes and phone numbers if you have them. 5. PLEASE PRINT (BLACK INK ONLY) OR TYPE FORMS. They must be legible in order for accuracy in processing FOR MONEY OWED AND/OR RECOVERY OF PERSONAL PROPERTY : 1. Copies needed for: One Defendant - Two (2) Complaints Four (4) Summons Two Defendants - Three (3) Complaints Five (5) Summons 2. The Complaint form parts that pertain to your case MUST be completed. This form MUST be dated and signed by the Plaintiff. 3. The summons MUST have the name and address of each Defendant after the word "TO". Please give home and work address, if possible. DO NOT SIGN THIS FORM. DO NOT XEROX THESE FORMS. They cannot be accepted. 4. When filing against a business, you must show the business is incorporated (Inc. or Co.) or if the business is a person doing business under an assumed name (EXAMPLE: John Doe doing business as John Does Towing Service). FEES : Filing Fee -- $45.00 Service Fee -- $5.00 for each Defendant. HEARING DATE : Cases are scheduled for court approximately 30 days from the time they are filed. You will be notified by mail of your court date, as soon as we know the Defendant(s) has been served.
