Fourth Circuit Notice Regarding Implementation of CM/ECF
| In November 2007, the U.S. Court of Appeals for the Fourth Circuit implemented the Case Management portion
of the Appellate Case Management Electronic Case Filing System (CM/ECF) developed by the judiciary for the
appellate courts. In 2008, the Fourth Circuit will implement the Electronic Case Filing portion of the system.
Counsel will be required to file all documents electronically with the exception of the appendix, which will be filed
conventionally; formal briefs will be filed both conventionally and electronically.
| Documents filed after November 13, 2007, are available on the Court’s internet site, www.ca4.uscourts.gov
(CM/ECF Docket link). Prior to implementation of electronic filing, the clerk’s office is scanning party filings into
electronic form and posting them to the docket. To facilitate scanning, please paper clip the original instead of
using staples and separate exhibits with divider pages instead of using tabs. Formal briefs, appendices, and
other filings too large to scan are not posted to the docket.
| Due to the noticing capabilities of CM/ECF, attorneys who have been receiving e-mail notice from the Court
through the Fourth Circuit’s FENS system will continue to receive e-mail notice through the CM/ECF system.
Notice is sent through a “Notice of Docket Activity,” which contains a link to the document on the Court’s docket.
There is no charge to access (and view, save, or print) the document for the first such access. Subsequent access
to the document or expanded access to the full docket requires a PACER login and password, which can be obtained
at http://pacer.psc.uscourts.gov/. An $.08/page fee ($2.40 cap per document) is charged for subsequent access to
the document or expanded access to the docket. Filtering software on counsel’s computers and servers must
be set so that it does not block delivery of e-mail from: ecfnoticing@ca4.uscourts.gov (new e-mail address).
| When the clerk’s office scans a party filing and posts it to the docket, CM/ECF sends e-mail notice to case
participants who have registered for electronic notice. Therefore, counsel registered for e-mail notice will receive
the document twice--once when it is served conventionally by the opposing party and once when the clerk’s office
posts an electronic copy to the docket. Until the Court implements mandatory electronic filing, parties must file
and serve documents conventionally. The electronic link is simply a courtesy copy sent with notice of posting.
| Sealed documents and financial affidavits are not part of the public file and cannot be accessed electronically by
case participants or the public. In immigration and social security cases, documents other than orders and opinions
can be accessed electronically only by case participants and only through use of a Fourth Circuit CM/ECF Filer
login and password. For all other case types and case documents, parties must remember that their filings will be
available on the Internet. Confidential and sensitive information (including social security numbers, juvenile names,
dates of birth, financial account numbers, and home addresses) must be excluded before the document is filed.
| When the Court begins electronic filing in 2008, the CM/ECF system will be used for electronic service of party
filings in addition to its current use for electronic service of Court documents, and all counsel will need to obtain
CM/ECF Filer logins and passwords. Prior to implementation of electronic filing, only attorneys participating
in immigration and social security cases must obtain CM/ECF Filer logins and passwords in order to access
sensitive electronic documents in those cases. To register for a Fourth Circuit CM/ECF Filer login and password,
go to http://pacer.psc.uscourts.gov/. Counsel not involved in social security or immigration cases may not register
for a CM/ECF Filer login and password until the Court implements electronic filing.
| Attorneys who have not previously registered to receive electronic notice from the Fourth Circuit may complete
the attached form and fax it to the Court.

To receive electronic notice of Court opinions, orders, notices, and correspondence through CM/ECF, please
complete this form and provide the e-mail address at which you wish to receive service of Court documents. A
separate form must be completed for each attorney participating. By signing the form, you consent to service of
Court documents by e-mail in all cases in which you are counsel of record, with the understanding that electronic
service will be the only form of service you receive. You also consent to future electronic service of party filings,
after implementation of electronic filing. Documents filed by counsel must continue to be served conventionally
pending full implementation of electronic filing.
