Pursuant to stipulation of the parties, this appeal is dismissed without
prejudice to reinstatement in the event the United States Bankruptcy Court declines
to approve a Motion to Approve Settlement which the parties hereto have reached.
Appellant must file a motion to reinstate the appeal with this court within 28
days of an Order by the United States Bankruptcy Court declining to approve a
Motion to Approve Settlement which the parties hereto have reached.
In absence of the appellant’s filing a timely motion for reinstatement, each
party shall bear its own fees and costs on appeal.
A certified copy of the order shall serve as mandate of the court.
