THE APPELLATE MEDIATION PROGRAM
The United States Court of Appeals for the District of Columbia Circuit has
established an Appellate Mediation Program to encourage the settlement of appellate
cases. Cases are selected for mediation jointly by the Legal Division of the Clerk’s
Office and the Director of the Appellate Mediation Program. They are mediated by
attorney-volunteers, who are selected by the Court and trained by dispute resolution
professionals to perform the service.
The attorneys who mediate in the Appellate Mediation Program are
distinguished members of the bar, experienced mediators in private practice and
members of local law school faculties. Mediators settle about a third of the cases they
handle.
All mediation sessions are confidential and, unless the parties request such a
change, do not alter the briefing or oral argument schedule. Information that is provided
to the mediator during the course of the mediation is not made available to the judges
and does not become part of the record on appeal.
Parties may request mediation by completing the “Request to Enter Appellate
Mediation Program” on the other side of this page and sending it to the Clerk of the
Court. Although such requests are not automatically granted, each request is given
special consideration.
