Sometimes parties have paid their child support directly between one another for a short period of
time prior to a wage attachment starting or due to employment changes. Consequently, the
Cuyahoga Support Enforcement Agency (CSEA) is showing an arrearage of child support that is
inaccurate. You need a Court order to correct this. If both parties are agreeable and no monies
are due the Department of Job and Family Services, an agreed motion to correct arrearages can be
filed.

The Motion to Correct Arrearages must be supported by a “Notarized Affidavit” (found on
this website) from each party stating that the monies were paid directly, their approximate
dollar amount and the time period for which they were due. Also, a statement needs to be
included as to whether or not the affiant (person signing or giving the affidavit) was
receiving any public assistance during the time period in question. An affidavit is a written
statement of fact that acts as evidence because it is sworn to and subjects the affiant to the
perjury laws of the State of Ohio. The affiant signs the document that he/she is swearing to
in front of a notary. There will be two of these affidavits in your motion.
