ELECTION OF SURVIVING SPOUSE TO TAKE AGAINST WILL
I, decedent's surviving spouse, elect to take against decedent's Will.
Decedent's Will, my rights under the Will, and my rights by electing to take against the Will,
have been explained to me.
I understand that by electing to take against the Will I am entitled to one-half of decedent's net
estate, unless there are two or more of the decedent's children or their lineal descendants surviving, in
which case I am entitled to one-third of decedent's net estate.
I further understand that had I elected to take under the Will, I would take under it alone as to
property governed by it, unless it plainly appears from the Will that the provisions in it for me were to
be in addition to an intestate share of the estate.
