KNOW ALL MEN BY THESE PRESENTS: (1) That in compliance with the provisions of Section 4735.25 of the Revised Code of Ohio, the undersigned, being the applicant for the registration of foreign real estate under Section 4735.25 and being the developer of the foreign real estate described in said application, and being (2) does hereby irrevocably consent that suits and actions growing out of a fraud committed by the applicant in connection with the sale in this state of foreign real estate may be commenced against it, in the proper court of any county in this state in which a cause of action for such fraud may arise, or in which the plaintiff in such action may reside, by serving on the Secretary of State of the State of Ohio any proper process or pleading authorized by the laws of this state, in the event that the applicant, if resident of this state, or the person designated by the non-resident applicant, cannot be found at the address given; and it is hereby further irrevocably stipulated and agreed that such service of such process or pleading on the Secretary of the State of Ohio shall be taken and held in all courts to be as valid and binding as if service has been made upon the undersigned developer itself.
