MOTION AND ORDER TO
TRANSFER FUNDS AND CLOSE
CONSERVATORSHIP
_______________________________________ (“Parent”) moves the Court for an order
approving transfer of conservatorship funds to a Uniform Transfers to Minors Act (“UMTA”)
account and closing the conservatorship. Parent respectfully represents:
1.
The value of the assets of the conservatorship is: $_________________, which is less
than $10,000. A copy of the most recent account statement is attached.
2.
Parent wishes to transfer the entire assets of Account #_______________________
at: ____________________________________________(name of financial institution holding
conservatorship funds) to a UTMA account. The UTMA account shall be restricted to provide
that no funds shall be withdrawn without prior court approval. The restriction will end when
Child reaches age 18.
3.
Parent agrees not to request court approval to withdraw funds from the account, except
in emergencies.
WHEREFORE, Parent prays for an order of this Court:

Authorizing the creation of a UTMA account at ______________________________

(name of custodian) as custodian.
2.
Restricting the UTMA account ot provide that no funds shall be withdrawn without

Authorizing the transfer of the conservatorship funds described above directly to the
UTMA account.
4.
Ordering Parent to provide the Court with an Affidavit and Acknowledgment of
Restriction from the financial institution holding the UTMA account, within 30 days of the state
of the order approving this motion.
5.
Authorizing the Conservator to be discharged and the file closed, upon filing of a
receipt of the conservatorship assets from the financial institution holding the UTMA account.
