Waiver of Personal Service and Selection of Substitute Method of Service In order to keep my personal identification information confidential, I wish to waive the requirement that the other party have me personally served with court documents, hearing notices, and other paperwork while this case is pending (being decided.) INFORMATION - Page 1 of 2 www.FormsWorkFlow.com Nondisclosure-8: NDMotion-8Ver01.doc (3/08) Points and Authorities  Intrastate paternity or support proceedings: ORS 25.020(8)(d)(A) provides that a court shall enter an order requiring that certain personal identification information about a party to a paternity or support proceeding not be contained in any document or otherwise provided to another party other than the state upon a finding, which may be made ex parte, that the health, safety, or liberty of a party or a child/ren would be unreasonably put at risk by disclosure of this information, or if an existing order requires such nondisclosure.  Uniform Interstate Family Support Act proceedings: ORS 110.375 provides that a court shall enter an order requiring that certain personal identification information about a party to a paternity or support proceeding not be contained in a pleading or any document filed in a proceeding under ORS 110.303 - ORS 110.452 upon a finding, which may be made ex parte, that the health, safety, or liberty of a party or a child/ren would be unreasonably put at risk by disclosure of this information, or if an existing order requires such nondisclosure.  Uniform Child/ren Custody Jurisdiction and Enforcement Act proceedings: ORS 109.767(5) provides that when a party alleges in an affidavit or pleading under oath that the health, safety, or liberty of the party or a child/ren would be jeopardized by disclosure of personal identifying information, the information must be sealed and may not be disclosed to another party or to the public unless the court orders the disclosure after a hearing in which the court takes into consideration the health, safety, or liberty of the party or child/ren and determines that disclosure is in the interest of justice.
