Appeal from Magisterial District Judge Sentence A defendant who has been found guilty or who has plead guilty to a summary offense may file an appeal with the Court of Common Pleas. There is a deadline of 30 days from the date of the District Justice's ruling. Summary Appeal Forms are available in the office of the Clerk of Courts or click on the link below, complete and mail. Should the defendant wish to file an appeal more than 30 days after the District Justice's ruling, it will be necessary for the defendant to file a Petition Nunc Pro Tunc. This is a request made to the Judge allowing the defendant to file for an appeal even though the deadline has passed. An attorney can assist the defendant in filing the Petition Nunc Pro Tunc. Information is also available in any law library. A non-refundable fee of $48.00 is charged by the Clerk of Court for the filing of any summary appeal or petition for nunc pro tunc.
