Case No. _____________________ _________________________ Defendant Agreement to Forfeit Property to Obtain a Defendant's Release (To be filed and redacted or placed under seal in accordance with the privacy requirements of FRCrP 49.1) To obtain the release of the defendant, we agree jointly and severally to forfeit certain property to the United States of America if the defendant fails to comply with any conditions of release set by the court, or fails to appear as required for any court proceeding or for the service of any sentence imposed as may be noticed or ordered by any court considering this matter. We declare under penalty of perjury that we are the sole owners of this property and that the property is not subject to any claim, lien, mortgage, or other encumbrance except as disclosed in the above description. We also promise not to sell, mortgage or otherwise encumber the property or intentionally do anything to reduce the value of the property as long as this agreement remains in effect. We deposit with the court the following ownership documents (describe and submit as an attachment the ownership and encumbrance documents): Surety Information. We understand that the court and the United States of America will rely on the surety information in approving this agreement. Conditions of Release. We agree that we have either read or had explained to us all of the court ordered conditions of release imposed on the defendant. Continuing Agreement. Unless the court orders otherwise, this agreement remains in effect during any appeal or other review until all court notices, orders and conditions have been satisfied by defendant. Exoneration of Sureties. This agreement is satisfied and ends if the defendant obeys all conditions of release, and court notices and orders to appear. Forfeiture.
