Notice to Petitioner:
Once the case has been filed, the petitioner(s) shall serve a copy of this Order Assigning Case to Judicial
Department on the respondent(s) with the summons and petition. Provided, however, that in those cases where
service is by publication, the petitioner shall serve a copy of this Order Assigning Case to Judicial Department to
within five (5) court days of service of the respondent's first response/appearance. If the case has not been filed, but
an initial pleading is served, a copy of this Order Assigning Case to Judicial Department shall be served within five
(5) court days of filing. PCLR 3(b)
Trial Date:
A trial date may be obtained pursuant to PCLR 40(d) by filing a ‘Note of Issue’ for assignment of a trial date by noon
at least six (6) court days prior to the date fixed for assignment of the trial date. PCLR 40(d)
If a trial date is not obtained pursuant to PCLR 40(d), failure to appear on this date will result in dismissal of the case
