Paragraphs 3.1, 3.3, 3.6, 3. 7. I. Hearing 1.1 A petition was filed requesting approval of a CHINS petition regarding the above-named child, and a hearing was held on (Date). II. Findings The Court finds: 2.1 Child222s Indian status: There is not a reason to know the child is an Indian child as defined in RCW 13.38.040 and 25 U.S.C. 247 1903(4), and the Federal and Washington State Indian Child Welfare Acts do not apply to this proceeding. The child is a child in need of services as defined in RCW 13.32A.030(5). b. The petitioner, if the child, has made a reasonable effort to resolve the conflict. c. Reasonable efforts have been made to prevent or eliminate the need for removal of the child from the child222s home and to make it possible for the child to return home. d. It is contrary to the welfare of the child to remain in or return to the child222s home. e. It is in the child222s best interest to be placed in foster care. f. A suitable out-of-home placement resource is available. III. Order The court orders that: 3.1 The petition is dismissed and the child shall return or remain at home. 3.2 The petition is approved. The Department shall have placement and care authority over the child, with authority to place the child and to provide services to the child and family.
