Comments:
The Supreme Court by order 97-10 created SCR 75 effective January 1,
1999. 2001 Wisconsin Act 61 codified the rule. One of the purposes of this
new rule is to distinguish supplemental court commissioners who perform
generally ministerial functions from "circuit court commissioners" who are
(in general) appointed or authorized by the chief judge to perform judicial
or quasi-judicial functions. [See GF-146 and the form summary for that
form for further clarification.]
Court commissioners appointed as supplemental court commissioners are
not required to comply with the continuing education requirements of SCR
75.05 so long as their activity is limited to these ministerial functions.
Additional duties may be delegated to a supplemental court commissioner
pursuant toe SCR 75.03. Form GF 146 should be used for this purpose.

A majority of the circuit judges of this county having approved the appointment of the above-named person as a
supplemental court commissioner,
IT IS ORDERED:
1. The above-named person is appointed a supplemental court commissioner under §757.675, Wis. Stats.
2a. The supplemental court commissioner may, under his or her own authority, exercise all of the powers
provided in §757.675(2),(3),(4),(5)and (6), Wis. Stats.
2b. The supplemental court commissioner may, under his or her own authority, exercise only the following
powers provided in §757.675(2),(3),(4),(5)and (6), Wis. Stats.:
Officiate at marriage ceremonies throughout the state.
Issue subpoenas and attachments or other process to compel the attendance of witnesses, administer
oaths and affidavits, take depositions and testimony when authorized by law or rule or order, and certify
and report the depositions and testimony.
Issue the following writs returnable before a judge at a time set by the judge or the judge's clerk:
habeas corpus; certiorari; ne exeat and alternative writs of mandamus.
Supervise accountings subsequent to a sale of land under chapter 75.
Issue subpoenas returnable before a judge on behalf of the Wisconsin department of justice for
antitrust violations under §133.11 (1) or violations of §§563.02 to 563.80 under §563.71 (1).
Investigate and dispose of unclaimed property under §§171.04 to 171.06.
Except as provided in §757.69(1)(p)3., conduct a paternity proceeding according to the procedures set
out in chapter 767 whenever a court commissioner is specifically authorized to do so.
Conduct supplementary hearings on the present financial status of a debtor and exercise the powers of
the court under §§816.04, 816.08 and 816.11.
Take and certify acknowledgments.
In addition to the duties expressly set forth in sub.(2)(a) to (i), a supplemental court commissioner:
may perform other ministerial duties as required by the court.
may transfer to a court any matter in which it appears that justice would be better served by such a
transfer.
shall refer to a court of record for appropriate action every alleged showing of contempt in the carrying
out of the lawful decisions of the supplemental court commissioner.
shall collect the fees prescribed in §814.68(1), appointed under sub.(1).
3a. This appointment shall continue until the expiration of the term of the appointing judge and until a successor
of the commissioner is appointed and qualified.
