Comments:
Any juvenile adjudicated delinquent for a felony act committed on or after
April 21, 1994, is restricted from possessing firearms. This restriction
continues even into adulthood unless the restrictions are removed by a
judge. §941.29(8), Wis. Stats., provides that the individual may petition a
court for removal of the restrictions. The statute does not limit the filing
of the petition to the court of the county where the adjudication occurred.
RMC believes this petition is not required to be filed in juvenile court, but
is actually a special proceeding filed with the circuit court. The hearing
would be an open proceeding. The burden is on the individual seeking
removal of the restriction to show by a preponderance of the evidence that
he or she is unlikely to act in a manner dangerous to public safety.
RMC believes the petition should include information for the court
concerning the status of the original dispositional order, any subsequent
adjudication or convictions, and other matters germane to the issue of
removal of the firearms restrictions.
