Pursuant to BMC & District Court Joint Standing Order 1-04, § V.B., an Order Nisi is hereby
entered that the above-captioned matter be dismissed based on the pendency of such
action for eight months or more without the filing of an answer or defensive motion.
You are hereby notified that a Judgment of Dismissal will be entered 30 days from the
entry of this Order Nisi unless the plaintiff, prior to that date: (1) files a request for entry
of default and default judgment in accordance with Mass. R. Civ. P. 55, or (2) files a written
report that the case is active and a request that it not be dismissed.
