WINERY / FARM WINERY FARMER'S MARKET
PERMIT APPLICATION
This application can be used by a winery or farm winery to apply for a permit under Section 76(5)
of the ABC Law to sell New York State labeled wine in sealed containers for off-premise
consumption at a State Fair, County Fair, or recognized farmer's market operated on a not-forprofit basis. An agent, representative, or solicitor from the winery / farm winery must be present at
the time of the sale.
This is a no fee permit and it is approved only for the State Fair, County Fair, or farmer's market
listed. A list of recognized fairs and farmer's markets can be obtained from the NYS Department
of Agriculture and Markets. You may mail your application to: NYS Liquor Authority,

A copy of the APPROVED permit must be available for inspection at the event.
