Commentary Acting as an athlete agent in Texas requires registration with the secretary of state, as provided in Chapter 2051 of the Texas Occupations Code and the secretary of state’s administrative rules found in 1 Texas Administrative Code Chapter 78. A registration is valid for one year and may be renewed. Unlike most states, which only allow individuals to register as athlete agents, Texas has two types of athlete agent registrations. An applicant for registration as an athlete agent in Texas may register as either an individual or an entity, as appropriate. The individual registration is intended for individuals or for businesses that are not formally organized as a separate legal “person,” such as a sole proprietorship or individual who does business under a d/b/a. This form is designed for the other type of athlete agent registration—registration as an entity. Use this form if you want to obtain athlete agent registration in the name of a corporation, LLC, partnership, or other legal entity. A business that is not formally organized as a separate legal “person,” such as a sole proprietorship or individual who does business under a d/b/a, may not obtain an entity registration.
