NOTICE
FORM L-30 (11/2006)
“On the death of the permittee or a person having an interest in the permit, or on bankruptcy, receivership,
or partnership dissolution, the receiver or successor in interest may apply to the county judge of the county where
the licensed premises are located for certification that he is the receiver or successor in interest. On certification,
unless good cause for refusal is shown, the commission or administrator shall grant permission by letter or
otherwise, for the receiver or successor in interest to operate the business during the UNEXPIRED PORTION OF
THE PERMIT. THE PERMIT MAY NOT BE RENEWED, but the receiver or successor in interest may apply for an
original permit or license. A receiver or successor in interest operating for the unexpired portion of the permit is
subject to the provisions of this code relating to the suspension or cancellation or a permit “Sec. 11.10 of the Texas
Alcoholic Beverage Code.”
Since the permit or license CANNOT BE RENEWED, an original application should be filed through your
local Texas Alcoholic Beverage Commission district office approximately 4 to 6 weeks prior to the expiration date of
the permit. This is to avoid interruption of the sale of alcoholic beverages. Licenses and permit expire one (1) year
from the date of issuance which is printed on the license or permit.
A successor in interest can only be granted as a result of bankruptcy, receivership, death or permittee or
person having an interest in the permit or partnership dissolution. It CANNOT be granted as a result of a divorce
decree.
Sec. 28.05 Renewal of Permit by Descendant or Surviving Spouse.
If the surviving spouse or surviving descendant of a holder of a Mixed Beverage Permit qualifies as the
successor in interest to the permit as provided in Sec. 11.10 of this code, the descendant or surviving spouse may
continue to renew by paying a renewal fee equal to the fee the permittee would be required to pay had he lived.
The preceding only applies to Mixed Beverage Permits as a result of the death of the permittee.
